The PROTECT Act did not, however, create a new crime of child pornographers. Rather, it increased the penalties on preexisting child porn laws and expanded the definition of child pornography. Child pornographers who had been convicted under the former federal law, which criminalized only the possession of child pornography in interstate or foreign commerce, and the previous federal law against child pornography, which also prohibited the transportation of obscenity, were required to register as sex offenders.2
The Child Pornography Prevention Act, or CPPA (passed in 1996, amended 2003, and again in 2006), prohibits the production or distribution of child pornography. It is a felony offense to produce or distribute child pornography.
The PROTECT Act also criminalized the production and distribution of child pornography, created stricter penalties for those convicted of the crimes, and imposed lighter penalties on those who were previously convicted of the crime.2
The Child Pornography Website Blocklist website provides a lot of information about the website and the images of child pornography that are being blocked. It says that the images are only visible if you use a search engine that uses a child exploitation content filter.12 The site also says that the images were blocklisted on November 7, 2013.
The Child Pornography Website Blocklist has been developed by the Noxious Materials Coalition, an American non-profit that focuses on the fight against child pornography. The coalition maintains a password-protected database of IP addresses that have been found to be distributing child pornography. The site has been around since 2006, but it was only recently that it was made available to the public.8
The site relies on voluntary reporting from Internet providers and search engines. According to Child Pornography Website Blocklist, they have identified more than 100,000 websites, although this number may be higher since the sites are only identified once they have been found to be distributing images of child pornography.9
The site itself is a free service, but Internet providers and search engines that use it have to pay a fee of $5-10 each time they are contacted by the site operators to identify an image of child pornography.10 The site operators then use this information to add the IP addresses to their list of websites known to distribute child pornography. If a site is added to the block list, it should be taken off the site and moved to a different IP address. The site operators also provide information about the images to the United States Postal Inspection Service and to federal and state law enforcement.11
